Question: Assalaamu AlaikumI live in the UK I took a Mortgage loan from the Bank over ten years ago but I have come to realize after studying the Quran that all transactions of Riba in any form are totally prohibited in Islam but with time I have also have saved sufficient money to pay all of the outstanding loan off InshaAllah but I have a guilty conscience telling me to give all of the money into Sadaqah (Charity in Allahs cause) as there is many needy people in the world that can benefit from these funds but on the other hand I have the prohibition of outstanding Riba hanging over my head which I feel is a much greater priority to clear off? Please advise me what is better in my caseI asked the local Imam but I wasnt satisfied with his answer as he told me that you already reside in the property with your family and you have no means of sufficient income to pay for rented accommodation so therefore its ok to live in the Mortgaged property and is in accordance with Sheikh Yusuf Qardawis Fatwah?Jazaak Allah khayranWa Alaikum Assalaam

If I understand your question, you want to ask that whether you should pay off the mortgage (your house) in full with the cash at hand, my answer is that you should not hesitate in doing so. Thereby you are freeing yourself from the burden of interest.  However, if you did not save enough to pay the entire mortgage, and you are able to pay only as they become due, in that situation, you may give the amount you have saved after your reasonable expenses in charity; the first thing is zakah and then comes other voluntary charities.

Buying a home by the mortgage is allowed as long as you have no other means of raising money to buy a modest house. This is the fatwa of Shaikh Qaradawi and the late Mustafa al-Zarqa; this is also the view endorsed by the European Council of Jurists.
