Question: BismillahAssalamualikumRespected scholar I am writing my will and I am confused about that I have heard that we could not do wasiyat for a legal heir.I have some jewellry and I would like to make a will that this would be distributed between my son and daughter equally. Is this permissible as I am aware that my son is entitled to receive double tham my daughter? Pls also explain the concept of hiba. As far as I know hiba is during the life if I make hiba equally to both my children can I write this in my will? Then could I still use my jewellry in my life. Jazkk'Allah khair
Answer:

You are allowed to gift your children during your life when you are well. While giving gifts you cannot discriminate; so, it is acceptable for you to divide the jewelry between your son and daughter equally if you intend to give it as a gift to them.
